1. Introduction

Welcome to MyMotorMate.

These Terms of Use govern your access to and use of the MyMotorMate website, vehicle marketplace, associated services and features.

By registering an account, publishing an advertisement, purchasing a service or otherwise using MyMotorMate, you agree to comply with these Terms.

Please read them carefully before using our services.

2. About MyMotorMate

MyMotorMate is a UK-based online vehicle advertising marketplace connecting buyers with private individuals and professional motor traders.

Our platform allows eligible users to advertise vehicles, browse listings, contact sellers and purchase optional advertising services.

Unless expressly stated otherwise, MyMotorMate:

• Does not own or sell advertised vehicles.

• Does not act as the seller or buyer in vehicle transactions.

• Does not inspect or mechanically certify vehicles.

• Does not guarantee the accuracy of advertisements.

• Does not handle payment for vehicle purchases.

• Does not guarantee that a vehicle will sell.

Any vehicle purchase agreement is made directly between the buyer and the relevant seller.

MyMotorMate provides the marketplace through which those parties may connect.

3. Eligibility

To register an account or advertise a vehicle, you must:

• Be at least 18 years old.

• Have the legal capacity to enter into binding agreements.

• Provide accurate registration information.

• Comply with applicable UK laws.

• Not be prohibited from using the platform due to previous serious breaches.

You must not create accounts using false identities or impersonate another individual or business.

We reserve the right to request additional verification where reasonably necessary.

4. Account Registration and Security

Users may be required to create an account to access certain features.

You agree to:

• Provide accurate and current information.

• Keep your login credentials confidential.

• Maintain the security of your account.

• Notify us of suspected unauthorised access.

• Accept responsibility for activity carried out through your account, except where the activity results from circumstances for which we are legally responsible.

MyMotorMate may use email or SMS verification to help protect the platform.

Verification of a telephone number or business record does not guarantee a user's identity or trustworthiness.

We may restrict, suspend or terminate accounts where reasonably necessary to prevent fraud, protect users or enforce these Terms.

5. Free Vehicle Advertising

MyMotorMate allows eligible private sellers to advertise vehicles without a standard listing fee.

Private sellers must be genuinely selling vehicles in a private capacity.

Businesses and professional motor traders must not use private seller accounts to avoid applicable commercial subscription fees.

Free advertisements remain subject to our listing rules, acceptable use requirements and any applicable published listing limits.

MyMotorMate may introduce or change optional paid services, but will not charge users without obtaining the required agreement to the relevant purchase.

6. Seller Responsibilities

By advertising a vehicle, you confirm that:

• You own the vehicle or are authorised to sell it.

• You have the legal right to offer it for sale.

• The vehicle information you provide is accurate to the best of your knowledge.

• Photographs genuinely represent the vehicle.

• You will disclose known material faults and relevant history.

• The advertised price is genuine and not deliberately misleading.

• You will not conceal known insurance write-off status or outstanding finance.

• You will respond honestly to reasonable buyer enquiries.

Sellers must update or remove advertisements that are no longer accurate or available.

You must not advertise vehicles that are stolen, unlawfully obtained or otherwise prohibited from sale.

MyMotorMate may remove listings that reasonably appear fraudulent, misleading, unlawful or in breach of these Terms.

7. Professional Motor Traders

Motor traders must register using accurate business information.

We may request:

• Registered company or trading name.

• Companies House number, where applicable.

• Business address.

• Business contact details.

• Evidence of trading status.

• Telephone verification.

We may check publicly available company records to help validate business details.

Motor traders are responsible for complying with applicable consumer protection legislation, including the Consumer Rights Act 2015 where relevant.

A trader must not falsely present themselves as a private seller.

Subscription allowances apply to simultaneously active vehicle advertisements.

Subscriptions are billed monthly and renew automatically until cancelled.

Applicable billing dates, cancellation arrangements, plan changes and any additional charges will be presented during subscription purchase and management.

Traders must not attempt to bypass advertisement limits by creating duplicate or misleading accounts.

If a subscription expires, is cancelled or becomes unpaid, MyMotorMate may restrict new advertising or pause advertisements in accordance with the subscription terms communicated to the trader.

Any plan prices shown are subject to the VAT treatment disclosed at checkout.

8. Spotlight Advertising

MyMotorMate offers an optional Spotlight service designed to increase advertisement visibility.

Private seller Spotlight

£9.99 per vehicle for 28 days.

Motor trader Spotlight

£5 per vehicle for 28 days, available to eligible subscribed traders.

Spotlight advertisements may receive enhanced placement in relevant search results and promotional areas.

Where multiple Spotlight advertisements qualify for a placement, visibility may rotate to provide fair exposure.

Spotlight does not guarantee:

• A specific number of views.

• Buyer enquiries.

• A completed sale.

• A particular search ranking at all times.

• Continuous appearance in every promotional area.

Spotlight advertising is a time-limited promotional service and does not automatically renew unless expressly agreed otherwise.

The duration and material conditions will be confirmed before purchase.

9. Payments, Cancellations and Refunds

Payments for subscriptions and promotional advertising may be processed by Stripe or another authorised payment provider.

You agree to provide accurate billing information and authorise the payments you expressly approve.

Subscriptions

Trade subscriptions continue until cancelled in accordance with the billing terms presented at purchase.

Cancellation prevents future renewals in accordance with those terms. Unless otherwise stated, cancellation does not automatically entitle a trader to a refund of fees already incurred.

Any applicable statutory rights remain unaffected.

Spotlight purchases

Spotlight advertising is purchased for a specified promotional period.

Where a consumer has a statutory right to cancel a distance contract, MyMotorMate will comply with the applicable cancellation requirements.

If a consumer expressly requests that a paid service begins during a statutory cancellation period, the consequences for cancellation and any proportionate charges will be explained and agreed where required by law.

We will not treat a service as automatically non-refundable merely because payment has been made.

Service problems

If a paid advertising service is not supplied as agreed, please contact us.

Any remedies, refunds or adjustments will be considered in accordance with the contract and applicable law.

10. Buying Vehicles Through MyMotorMate

MyMotorMate is an advertising marketplace rather than the seller of vehicles listed by independent users.

Buyers are responsible for undertaking appropriate checks before agreeing to purchase.

We strongly recommend:

• Viewing the vehicle in person.

• Checking the V5C registration document.

• Confirming the vehicle identification number.

• Reviewing MOT history.

• Checking for outstanding finance.

• Investigating insurance write-off history.

• Inspecting service and maintenance records.

• Conducting a suitable test drive.

• Considering an independent mechanical inspection.

• Verifying the seller's identity.

Never send money to an unknown seller without taking appropriate precautions.

A vehicle appearing on MyMotorMate does not mean it has been independently inspected or approved by us.

Your legal rights against a seller depend on the circumstances of the sale, including whether the seller is a trader or a private individual.

Nothing in these Terms limits your statutory rights.

11. Fraud Prevention and Prohibited Activity

MyMotorMate has a zero-tolerance approach to deliberate fraud.

Users must not:

• Publish fraudulent advertisements.

• Advertise stolen vehicles.

• Misrepresent vehicle mileage or condition.

• Conceal known material information dishonestly.

• Impersonate buyers, sellers or businesses.

• Use false business credentials.

• Attempt phishing or payment scams.

• Upload malicious software.

• Harass, threaten or abuse other users.

• Collect user information for unauthorised marketing.

• Manipulate advertisement views or Spotlight rotation.

• Interfere with website security.

• Use automated scraping or bots without permission.

We may investigate suspected breaches and take proportionate action, including advertisement removal, account suspension or reporting suspected criminal conduct.

12. Advertisement Content and Photographs

Sellers retain ownership of their original photographs, descriptions and other content.

By uploading content, you grant MyMotorMate a non-exclusive, royalty-free licence to host, reproduce, display, format and promote that content for the purpose of providing and marketing the marketplace.

This licence applies for the period reasonably necessary to operate the service and meet applicable legal obligations.

You confirm that you have the necessary rights and permissions to upload the content.

You must not upload copyrighted photographs or other material without appropriate permission.

MyMotorMate may remove content that infringes third-party rights or breaches these Terms.

13. Search Results and Advertisement Ranking

MyMotorMate provides search and filtering tools to help users discover vehicles.

Search results may be influenced by:

• Vehicle category.

• Make and model.

• Asking price.

• Vehicle location and selected search radius.

• Listing relevance.

• Advertisement status.

• Paid Spotlight promotion.

Spotlight placements are promotional and should be distinguishable from ordinary listings where required.

We do not guarantee that every vehicle available in the market will appear in our search results.

Location calculations may rely on postcode coordinates and geographic distance calculations.

14. Vehicle Data and Third-Party Information

Some vehicle information may be obtained through external sources, including DVLA, DVSA and other vehicle information providers.

We take reasonable steps to present information accurately but cannot guarantee that all third-party data is complete, current or error-free.

Users should independently verify important vehicle details.

MyMotorMate is not a substitute for professional vehicle inspection or an appropriate vehicle history check.

15. Finance and External Services

MyMotorMate may display links or information relating to independent finance providers, including Zuto.

Any finance application, credit assessment or lending agreement is handled by the relevant provider.

MyMotorMate does not itself provide credit, approve loans or guarantee finance eligibility.

Finance providers operate under their own terms, privacy policies and regulatory responsibilities.

Any referral, commission or regulated financial activity will be disclosed and handled as required by applicable law.

16. Messages and User Communications

Where MyMotorMate provides messaging or enquiry functions, users must communicate respectfully and lawfully.

You must not use the messaging system for spam, harassment, fraud or unrelated commercial solicitation.

Messages may be processed and retained for service delivery, security, dispute resolution and other lawful purposes as explained in our Privacy Notice.

We may investigate reports of abusive or fraudulent communications.

We do not guarantee that messages will always be delivered immediately or that another user will respond.

17. Website Availability

We aim to keep MyMotorMate available, secure and functioning correctly.

However, temporary interruptions may occur because of:

• Maintenance.

• Software updates.

• Technical faults.

• Hosting or network failures.

• Security incidents.

• Third-party service outages.

We do not guarantee uninterrupted access.

Where an outage materially affects a paid service, we will consider our contractual obligations and applicable consumer rights.

18. Intellectual Property

The MyMotorMate name, branding, website design, software, original written content and other proprietary materials are owned by or licensed to the platform operator.

You may not reproduce, redistribute or commercially exploit these materials without appropriate permission, except where permitted by law.

You may share links to publicly accessible vehicle advertisements for legitimate purposes.

19. Privacy and Cookies

We process personal information in accordance with our Privacy Notice.

Our use of cookies and similar technologies is explained in our Cookie Policy.

By using the platform, you acknowledge that these policies provide information about our data processing practices.

Where consent is legally required, it will be requested separately. Acceptance of these Terms does not replace legally required privacy or cookie consent.

20. Limitation of Liability

MyMotorMate acts primarily as an intermediary connecting independent buyers and sellers.

We are not ordinarily a party to vehicle sale agreements and are not responsible for a seller's contractual obligations merely because the vehicle was advertised on our platform.

We do not guarantee the condition, safety, legality, ownership or availability of independently advertised vehicles.

We are not liable for losses caused solely by the independent actions of buyers or sellers where the law does not impose responsibility on us.

For business users, our liability may be subject to additional reasonable contractual limitations, where enforceable.

Nothing in these Terms excludes or limits liability for:

• Death or personal injury caused by negligence.

• Fraud or fraudulent misrepresentation.

• Any liability that cannot lawfully be excluded.

• Statutory consumer rights and remedies.

We remain responsible for our own obligations under applicable law.

21. Suspension and Termination

We may suspend, restrict or terminate an account where there are reasonable grounds to believe that a user has:

• Engaged in fraudulent activity.

• Seriously or repeatedly breached these Terms.

• Provided materially false information.

• Misused payment services.

• Threatened other users or platform security.

• Used the platform unlawfully.

Where appropriate, we may provide an explanation and an opportunity to resolve the issue.

Users may request account closure by contacting us.

Closure of an account does not automatically remove outstanding payment obligations or information that must lawfully be retained.

22. Changes to These Terms

We may update these Terms to reflect changes in legislation, marketplace functionality, security requirements or commercial services.

The current version will be published on our website.

Where material changes affect existing paid agreements, we will provide notice and obtain agreement where required by law.

Changes will not retrospectively remove accrued statutory rights.

23. Governing Law and Disputes

These Terms are governed by the laws of England and Wales, subject to mandatory consumer protection rules.

If you have a complaint, please contact us so that we can investigate.

Nothing in these Terms prevents consumers from exercising their rights to bring proceedings in a court that has jurisdiction under applicable law.
